It is therefore important to us at Treschow & Partner that you, whose personal data we may collect, are aware of how we handle your personal data and why we handle and store your personal data. To explain this in a clear and accessible manner, we have therefore chosen to prepare the following document. We hope that you will find the information you are looking for in this document.

YOUR RIGHT TO YOUR DATA 

If we process or store your personal data, it is important that you are aware of your rights concerning our processing thereof. You are entitled to exercise these rights, and should you wish to do so, please feel free to contact us using the contact details set out on the final page. 

Rectification 

You are entitled at any time to have any data we hold concerning you rectified should we possess inaccurate information about you. Furthermore, in the event that our information is incomplete, you have the right to request that it be updated by submitting supplementary information to us. 

Complaint 

Should you believe that we have mishandled your personal data, you are fully entitled to lodge a complaint with the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten). You are also welcome to contact us directly and we will remedy the matter. 

Erasure of personal data 

If we process your personal data exclusively for marketing purposes, you are entitled to request immediate erasure or restriction of your personal data. However, there are circumstances in which we may be unable to erase your personal data, for instance where we are legally obliged to retain it. 

Withdrawal of consent 

During the period in which we store your personal data, you have the right to withdraw your consent with immediate effect. You may withdraw your consent in whole or in part by specifying this upon contact with us. 

Data portability 

You are entitled to request your personal data in a structured, commonly used and machine-readable format where you have provided such data to us. You also have the right to have such data transmitted to another data controller where technically feasible.

Right of access 

As a data subject registered with us, you have the right to request a copy of the personal data we hold about you. You also have the right to know how we process your data and to receive information about which personal data we process concerning you specifically. 

PERSONAL DATA WE PROCESS FOR MARKETING PURPOSES

Personal data

The data we store for marketing purposes is name and email address.

Purpose

We process your data for the purpose of sending marketing in the form of newsletters and articles we consider may be of interest to you. This communication takes place by email.

Legal basis for processing

Information for marketing purposes is sent on the basis of the consent you provide when you choose to contact us via the form on the website.

Controller

The legal entity responsible for your personal data is Advokatfirman Treschow & Partner AB, org. no. 559076-1119.

Access

Those who have access to your personal data are employees of Advokatfirman Treschow & Partner AB. The data you provide to us for marketing purposes will not be shared with third parties.

Storage

We store your data for a period of 3 years, unless you cancel your membership by contacting us. If you wish to cancel your membership, we will promptly delete your personal data from our system. If, after 3 years of membership, you have not shown any interest in our services, we will remove you from our newsletter and delete your personal data. At that time, we will send an email before deleting your personal data, asking you to consent to us storing your personal data again and sending newsletters for a new 3-year period. If you choose not to consent to this, your data will be promptly deleted. If you choose to consent, we will continue to store your data for the next 3 years.

You also have the full right, during the time we store data about you, to withdraw your consent to our processing of your personal data. We will then immediately delete this data from our systems.

APPLICATION FOR EMPLOYMENT 

The personal data we store consists of the information you provide when applying for employment. This data includes, inter alia, name, address, personal identity number, email address, educational background, CV photograph (if applicable), grades, work experience and any other information you choose to provide about yourself. 

The purpose of our processing of your personal data in connection with an employment procedure is to conduct recruitment in which we assess your skills against the qualities we seek in an employee at Treschow & Partner. 

Legal basis 

The legal bases for processing your personal data are primarily our obligation to observe the rights of parties in the labour market under employment law and your consent. As a legal basis for processing, we also rely on a balancing of interests. 

Legitimate interest assessment: 

  • To enable us to access and collect the information necessary to assess your suitability and qualifications for employment with us. Such information may include your CV, cover letter, academic results and degree certificates. 
  • In order to book a job interview 
  • The processing of your personal data is carried out on the basis of a legitimate interest in recruiting new employees to Treschow & Partner. 
  • The processing is necessary due to the parties' obligations and specific rights under employment law. 
  • In the event that we become subject to claims pursuant to the Discrimination Act, we will process your personal data for the purpose of safeguarding our legal rights. 

Consent: 

  • We store your data in the event that, in a future recruitment process, we consider you to be of interest for a position we are seeking to fill,

Access 

The information you share with us remains within Treschow & Partner and will not be shared with any third parties. 

Storage

Where our storage of your personal data is based on a legitimate interest assessment, your data will, as a general rule, be deleted from our systems when the current recruitment process is completed. 

Where we store your information on the basis of your consent, we will retain your personal data in our systems for a period of 18 months (1.5 years) following completion of the recruitment process. This is to enable us to safeguard our rights under the Discrimination Act. 

Where the processing is necessary for the controller or the data subject to fulfil their obligations and exercise their specific rights under employment law, we retain your data for 2 years. 

Should you consent to our continued retention of your data in our systems for the purpose of possible future recruitment, we will store such data until such time as you withdraw your consent to our processing of your personal data. 


EMPLOYEES 

Data 
The personal data we handle during your employment with us comprises: name, telephone number, postal address, photographs (where applicable), email address and bank account details. 

Purpose
This is for the purpose of fulfilling our obligations to the Swedish Tax Agency, accounting obligations and salary payments. 

Legal basis 
For you as an employee, we will process your data on the basis of consent, whereby you have consented upon employment to us storing and handling your data. In addition to consent, the employment contract constitutes the legal basis for processing your personal data. 

We must also process your personal data due to legal obligations, as we are required by law to report this data to authorities such as the Swedish Tax Agency. 

Responsibility
The data controller responsible for your personal data is Advokatfirman Treschow & Partner AB, org. no. 559076-1119.

Access
The information that may be shared with third parties includes your name, any photograph and your contact details at the workplace in order to enable you to fulfil your duties as an employee at Treschow & Partner. This will be done through social media such as Instagram, Facebook and our respective websites. Other information that will be shared with third parties includes your national identification number and bank account details in order to pay your salary and as accounting documentation to the Swedish Tax Agency 

Storeage

The personal data we process in order to fulfil our contract with you as an employee is retained, as a general rule, for the duration of your employment, unless otherwise required by, for example, legal obligations. This is to enable us to fulfil our commitments to you and to administer our contractual relationships and exercise our rights. When your employment with us ends, we will cease processing your personal data immediately. 

This is with the exception of information required for accounting purposes, which must be processed for 7 years in accordance with the law. Inactive contracts containing your personal data will be retained for a period of 10 years due to the limitation period under the Statute of Limitations.


Clients

Collection of personal data 

Personal data relating to you as a client is collected when you contact us for the purpose of engaging our services for assignments or advice. We may also, in connection with the performance of assignments, obtain information about you from various authorities or via social media. 

Type of Data 

  • The personal data we retain concerning you as a client may include: full name, national identification number, organisation registration number, information about your employees, postal address, email address and bank account details. 

Special categories of personal data:

  • In the course of our assignments, we may store data that is considered sensitive, such as information about criminal offences, ethnicity, political opinions, religion, sexual orientation, sex life and possible membership of a trade union. 

Other individuals :

  • We process data relating to individuals in connection with our cases. The individuals whose data we process may include judges, witnesses, expert witnesses, opposing counsel, contracting parties and others. 

Opposing parties: 

  • We process data relating to representatives of legal entities, employees and opposing parties who are natural persons. The data we store may include name, employer, national identification number and contact details. 

Purpose

We use your personal data for the purpose of performing our assignment for you as a client and to fulfil obligations stipulated by law and towards various authorities and insurance companies. 

Legal Basis

Legitimate interests:

  • Due to the fact that we as a law firm are bound to operate in accordance with the Swedish Bar Association's regulations concerning legal practice and to defend ourselves against legal claims. 
  • To enable us to maintain contact with you via telephone, email and postal correspondence. 
  • To enable us to organise and schedule meetings with you. 
  • To enable us to protect our rights in the event of legal claims brought against us. 
  • To enable us to prepare and process fee statements and invoicing. 
  • in order to provide and maintain correct documentation, administration and case management of your matter. 

Our right to hold your personal data is not a statutory requirement, but is nevertheless necessary for you to be our client. In the event that you choose not to provide personal data to us, we will not be able to fulfil our assignment to you as a client in full. Consequently, we will not be able to represent you. 

Our legitimate interests for the above purposes are to safeguard and protect our interests and rights in the event of legal claims. This also applies to the administration of our relationship with you as a client/opposing party/other party in connection with ongoing case management, and to comply with the ethical requirements applicable to us as a law firm. 

Legal obligation: 
To enable us to carry out conflict of interest checks, which we as a law firm are required by law to conduct in order to ensure that there are no conflicts of interest amongst the parties involved. 

Contractual obligations: 

  • To enable us to carry out invoicing, payments and payment reminders. 
  • To process and manage client receivables arising from case handling. 
  • To process and manage our accounting.

Asset

As a law firm, we work in accordance with statutory requirements regarding professional secrecy and attorney-client privilege, and we therefore rarely disclose your personal data. However, if we need to do so for any reason, this will be done to: 

  • Opposing parties and opposing counsel in connection with the matter.  
  • IT systems where we manage among other things, our accounting and data systems for cloud storage.
  • Your insurance company when applying for legal expenses insurance. 
  • The Swedish Bar Association if such reason exists. 
  • Police if stipulated by law .
  • Authorities if stipulated by law.
  • Banks, insurance and debt collection companies, for example in the handling of estates. 

Storage

According to the Swedish Bar Association, we are obliged to archive all cases for 10 years after the case has been closed, or even longer if there are special reasons. This means that the personal data relating to your case and which for any reason occurred during the course of the case will be kept by us for a period of at least 10 years after the closure of the case 

The same applies to our obligation to always conduct conflict checks when taking on new clients. We are therefore also obliged, according to the limitation period in the Limitation Act, to store your personal data such as name and personal identity number in our conflict register for 10 years. 

In order to fulfil our obligations stipulated under the Accounting Act, we have an obligation to archive information relating to accounting for a period of 7 years. We may therefore store information relating to payments and invoices with us during this time. 

The information that we process for the purpose of fulfilling our assignment to you as a client is therefore only processed for the time that we are legally obliged to do so. Other reasons why we may need to save your personal data in our systems are to be able to administer the contractual relationship, exercise our rights as a firm and fulfil our commitments to you as a client.
